Legal Question in Employment Law in California

return to work after disability

I broke my ankle and have been off for almost 60 days, amd receive state disability. (California)

I am to return to work in a couple of weeks. I have been salaried. My employer wants to reduce my salary by $2000 per month then pay commissions from what I sell. Is this something he can do? There was never a discussion about this at the time of my accident.

Re: return to work after disability

It could be argued that is a violation of the FMLA requirements that you be brought back to the same or similar job, duties and compensation. If you can't resolve it with the employer, get an attorney to intervene and try to talk sense to them before jumping into a lawsuit. Feel free to contact me if you need legal help in this.
