Legal Question in Personal Injury in California

Auto Accident 11/19/02 - I was injured passenger

I was a passenger in a car that went off the frwy and hit a guard rail & wall.

The car was not drivable but the driver called a tow truck & not the police. He

never submitted a claim.He was driving too fast. I was in the backseat &

discovered a few weeks later that I had back and neck problems.I have not

hired an attorney, the insurance company of the driver has reimbursed me for

expenses so far, but I have concerns about statutes, etc. Do I need to hire an

attorney? I have not had much relief from my injuries,I require frequent

medical & PT, my MRI shows some problems & I am afraid this can go on for

years.It's difficult for me to hold a full time job because of the pain & as a

student I have had to obtain disabilty exceptions for my classes. Please advise

me as to what I should do and how.

You should have a lawyer review the situation in detail and advise you of your options, pros, cons, etc. Certainly any of the lawyers on this site are qualified, capable and willing to do so. There is usually no charge for this type of consultation.

The easy answer is that you should have gotten an attorney to start with. It is not too late, but is getting there. The Statute of limitations is a concern that could bar your recovery. Feel free to conact me if interested in getting honest and experienced representation.

Yes--you do have to be concerned with statutes and time limits. And other things--are you getting the proper medical care, are all your claims being documented properly, should you get different medical care?---If you have health ins and your own auto ins, how does that factor in?
