Child Support

Hello,

I had filed for child support back in Aug of 07.We have 2 children I have the 11yr old boy & he has our 19 yr old daughter. He was told that he had to begin paying the child support in Oct.07. I did not get any payments till the end of Dec.07. And I have not recieved anything else to this date. He called me and said that he was going to file a child support case on me for our daughter who is 19 lives w/his parents and he does nothing for her she rarley see's him. Can he do this? She is currently working and fending for herself and I send her money when I can. Would that mean that he would not need to pay child support for our son? They live in NY and I in Florida. What would happen? What could I do about this? He said he was tired of them threatining him for not paying the child support and there for he is now filing for it on behalf of our daughter.Could you please give me some advice on what I should do?

In order for him to convince a Court to require child support he would have to establish that the child resides with him. If he filed for child support in New York that state would have to determine if child support can be ordered for a 19 year old. I would suggest that you contact the Florida Department of Revenue to assist you in collecting the child support owed for your son. They can initiate an interstate case to bring him into Court in New York.
