Legal Question in Family Law in Florida

But even if my legal papers for the custody of my grandson are from New York, can I go and get this chid without letting my son the childs father now, and bring him back home with me, or will this be consider as kidnapping?

The police wouldn't let you take him based on your guardianship papers before, do you want to risk jail using them as a defense against a kidnapping charge now? I doubt the kidnapping charge would stick, but who'd want to spend a day or ten in jail to find out?
