Legal Question in Employment Law in Florida

I was laid off the day i was injured on job. Insurance company says they cannot pay for lost wages after i was laid off. Unfortunatly he said i was laid off new years eve but was going to call me sunday to come in to work monday. Just for monday. Do i have an arguement?

If you were employeed at the time you were injured, you should be entitled to worker's compensation depending on the severity of your injuries. Laying you off on the day of your injury would likely be viewed as an attempt avoid your coverage. One thing to note, if you recover worker's compensation you cannot sue your employer for your injuries but you can sue any third party that may have contributied to your injuries. If you do not recovery worker's compensation, you can sue your employer for your injuries (provided they were someway involved with creating the atmosphere or situation which lead to your injuries) and any third party that may have contributed to your injuries.
