Legal Question in Employment Law in Florida

Who has to leave the job if a man has a restraining order filed against him and he works with the person who filed it? No crime has been committed, she is claiming to be frightened something may happen. He has worked there longer. This is a couple who just broke up. No prior record on the man of any type of crime.

The typical injunction of this sort will enjoin him from going to her place of employment as well as where she lives. If it does not prevent him from going to the place of employment, he can go there to work. Frequently after a breakup, neither party can act like an adult, and the fear is that she can have him arrested for supposedly violating the injunction. Care should be taken to ensure that there are adequate witnesses at all times around each of them for at least a few weeks.
