Non Compete tied to severance

Can an employer force an employee being laid off to sign an non compete agreement before the agreed upon severance money is to be paid. Non compete agreements was never a condition of employment either before hire or while employed.

It depends on when the agreement for severance was made. A non-compete agreement must be supported by consideration, and severance pay that was not previously agreed to can be that consideration.

But the reality is, if you do not sign, you will probably not get the severance.
