Wage garnishment by ex employer

It has been 7 days since the last pay period where my employer instructed me to show at 5:30 to pick up my last pay check. When I get there the owner states he mailed it , we are in the same town and I still have not received my check, they dont return my calls and I left a message to the labor dept. I had bills falling behind because of this. Can I sue him? Please help.

Yes.

Fax him a letter indicating that you have tried to call and can't get a response. Let him know you need to get paid and if not paid by a date certain that you will need to sue -- in which event he will be responsible for the costs of suit.

Be nice but be firm.
