Disbursement of Settlement

I was rear ended last year. The other persons insurance says that even though my personal medical insurance paid my injuries for an agreed upon less amount than the original invoices, that I will not get the excess left from the settlement even though those original amounts were the numbers used to reach the settlement amount. Is this right?
