attorney fees

my attorney had me sign a contract that she would not allow me to take home and read first in the contract it says i could be liable for expensive attorney fees she stated that it is ilegal to say they will do my case free so they have to stat fees however even if i get a bill later just throw it away they would never try to collect. I call again today told the attorney that I did not get a copy of the contract and that I felt worried she said no dont worry thier will be no fees charged to you.

First, you have a right to receive a copy of your contract. Call or write and demand a copy of the contract so you can have it for your file. If the attorney refuses, tell them that you either want a copy of the contract or you will go to another attorney. Period.

I have heard that if there are moneys that an attorney spend and then the case is a loss, he or she has to show the IRC that an attempt to collect the debt has been made (a demand letter to the debtor) in order for the IRC to allow that debt to be declared a business loss and therefore allow the attorney to take a deduction for it. Many do that. It is possible that your attorney means just that.

However, you are bound by the words in your contract. And should the above explanation not be the case, you have an obligation to pay whatever the contract your signed says you must.
