Legal Question in Civil Litigation in Maine

property line dispute

I need to know what steps to take in order to get my neighbors junk off my property. He says that he owns 22 feet from his house up my way. This is now the zoning law, but 50 years ago when the homes were built that was not the case. I have a survey showing where my line is. What do I do now, as he refuses to accept this fact, and also refuses to remove his belongings?

A letter to him from an attorney with a copy of the survey should do the trick to dispell his mistaken belief as to the property line. If not, then you will need to file a lawsuit requesting an injunction order from the Court for removal of the junk and requesting damages from the neighbor.

I agree with the response of Attorney Gamache, with one additional comment. You could go to the police first, explain your situation and show them the survey, then request that they issue a trespassing warning to the offending neighbor. They may not get involved due to the matter being "civil" in nature, but it's worth a try. Good luck!
