retainer agreement

it states, in the event an offer has been conveyed

the fee is 33 1/3% of offered amount unless suit or arbitration has been instituted in which case the fee will be 40%. ? if an offer was made prior to the

filling of suit, is it 40% of the difference of the

amount offered before suit.

? in this case dose suit mean go to trial.

Typical arrangems give the attorney 1/3 if settled prior to suit being filed, and 40% after suit is filed. From the language you provided, it sounds like this was the arrangement. If an offer was made before a suit was filed, but rejected by the Plaintiff, and then a lawsuit was filed and a settlement only reached then, the 40% amount should apply.
