Legal Question in Credit and Debt Law in Maryland

creditor not listed on chap 7 bankruptcy

I received a chap 7 no asset discharge in Jan 08. A creditor of mine was not listed on the paperwork but I met with him and told him that I had filed for bankruptcy. Now he has filed a lawsuit asking for monies on the grounds he was not listed as a creditor. Paperwork from the court asks for a response from me by motion or pleading. What should I do?

Re: creditor not listed on chap 7 bankruptcy

You need to file a response to the lawsuit asserting that it was discharged in bankruptcy, and move to reopen the bankruptcy to enforce the discharge and to hold the creditor in contempt. Your bankruptcy lawyer should be able to do this for you.
