First of all, you have to submit a claim, fully documented by medical records and bills, to the State Treasurer, within 1 year of the incident. If you fail to do this, you can't file a suit. Also, you have to wait until the state denies your claim before you can file a suit, which suit still must be filed within 3 years of the incident. As for the length of time it takes the state to respond, that depends on the complexity of the claim, the number of claims presently under consideration, and the efficiency of the state's claims department.
