Trademark Law

The company name I want is already in use but it is a generic word;example - RAINBOW. There is already Rainbow,Inc. I want to do mine was Rainbow Industries. Can I do that?

For a corporate name, that would work. XYZ, Inc. and XYZ Industries, Inc. would not be considered the same, and if one is taken you could incorporate as the other. However, for a trademark, it is probably a different situation, but it would depend on the mark and the respective uses to which it is being put.
