forcing sale of a house i'm on title of

i currently own a house with two other

indivuduals, i'm not on the load, but i'm

on the title and deed and i want to force

sale of the house. how can i do this, and

can they tie this recourse up in court, or

can i immediatly do this.....they are

dragging their feet upon buying me out

and i need to take action.

You will have to file a suit for partition and sale of the property. The suit would be filed in the circuit court of your county, which appears to be here in Montgomery. If there is a dispute as to the relative shares of the 3 joint owners, you can also ask the court to resolve that dispute. This may take some time to get through the court system, but ultimately you should be successful in getting the court to order the sale. A trustee would be appointed by the court to do this.

Since the suit will result in significant additional expense to all parties (for example, the trustee would be paid a fee in addition to any brokerage commissions), you might point this out to the others in the hope of persuading them that it would make sense to reach an agreement to either buy you out or put the property on the market.
