Legal Question in Wills and Trusts in Nevada

My husband passed away in a car accident and I was never asked what I wanted done with his body nor did I sign anything. His mother went ahead and did what she wanted with him without my permission. And nobody at the Funeral Home ever called me and asked me what I wanted done even though they knew he was married. What can I do about this? Because I've been having problems getting his ashes and his mother wants me to pay back everything. But I"m not allowed to touch his ashes or the flag that was issued to him by the va. Isn't that illegal?

If your husband had a Will or Trust that named his mother executrix or trustee, then I could understand why this happened. If not, then you, as his legal wife are his next of kin and I am surprised this took place--perhaps they didn't know he was married or how to contact you...

I don't know where or when he died. It is possible that a probate estate has been opened or should be opened. I don't have enough information.

You should privately consult with a competent Nevada attorney.
