Legal Question in Employment Law in New Jersey

I am Robert Nartey, former CFO of a non-profit based in Atlantic City - Atlantic Human Resources, Inc, a $15 million community service org in the Headstatrt & Early HS, CNS/FGP, CNS/RSVP, HUD and USDA Aff Federal Funding.

I blew the whistle in 2011 & 2012 about illegal activities and violation of Federal rules.

The FBI, the OIG (DHHS, CNS, USDA, HUD) all sent investigators and CPA's who agreed with me that there was enough grounds to stoll ALL funding.

My lawsuit initially was for failure to promote to deputy of the Exec. Dir/CEo, constant harrasment as an African working in a predominantly African-American organization. The Ceo had said that "Africans sold his ancestors into slavery and he will never promote me to become the next Ceo" I have witnesses. So I file for discrimination harrassment and later violation of CEPA rules and wrongful termination in retaliation for blowing the whistle.

Costello & Mains my Employment attorneys indicated that they believed the insurance policy for the larger claim may have lapsed but there may be insurance for the hostile work environment claim. I proceeded in the Bankruptcy Court and got permission to pursue that insurance.(Philadelphia Insurance) For A million dollar insurance policy that was in force on 03/12/2012, the filing of my lawsuit. Policy expired in March 2013 for non-paymen.

In 2013, Costello & Mains offer of $150,000 settlement was rejected by attorney for the company. The company filled for bankruptcy in June 2014, just as Trial was to begin.

Costello & Mains abandoned my case saying it is unlikely for them to receive any payment in view of the bankruptcy. The Philadelphia Insuranced has offered to settle this out of court. Now Costello & Mains want to lo lowball the offer starting at $25,000 plus attorney fees of nearly the same $25,000.

I will rather pursue Philadelphia insurance for my pain and suffering, my 3 months unpaid wages and accrued vacation than settle for $25K Please advise if there id the slightest possibility for negotiating a better settlement based on the law.
