Legal Question in Traffic Law in New Jersey

NJ 39:4-97 a misdemeanor or petty offense?

In filling out an application that says, ''Have you ever been charged with, convicted of, or pled guilty or no contest to a felony or misdemeanor charge, including a moving traffic violation?'' I am trying to ascertain whether I must say yes for having been found guilty in 2003 of ''careless driving'' 39:4-97 (different from reckless driving, which I know is a misdemeanor). From what I understand careless driving is just a petty offense. I paid the fine and the two points have long cleared my record... just need to know if careless driving as NJ defines it is an actual misdemeanor. If the answer is yes, wouldn't that make tons of people in NJ guilty of misdemeanors?

It is not a felony or a misdemeanor. It is just a small traffic ticket, and I can't even begin to imagine why they would ask this on a job application. Just tell them you got a little traffic ticket and just had to pay a fine.

We do not have misdemeanors in NJ. Furthermore, that term is used with regard to a criminal offense. You pled out to a traffic offense. Not a big deal at all. Someone or something is giving you wrong information.

Reckless driving is not a petty criminal offense; it is a motor vehicle offense, as is careless driving. Neither is a misdemeanor.
