Legal Question in Criminal Law in New York

Can I be criminally charged for selling items my corporation was throwing out. These items were given to me by a warehouse manager and were not in the inventory, hence the reason for discarding.

The answer is: Probably. The reason why is that there is likely a discrepancy between what you were told by the warehouse manager and what the actual situation was. There's also a fundamental legal difference between 'was throwing out' and 'actually threw out'. It's akin the difference between going through someone's garbage in their bin and dumpster diving.

If you've been arrested or have been contacted by either corporate security or law enforcement, you should immediately seek out legal counsel and representation.
