Legal Question in Real Estate Law in Ohio

Our home owners association registration has expired with the Ohio secretary of state. All of the people in the neighborhood received their dues invoice, but were wondering if it was legal for them to bill us when the business has failed to reinstate with the state. We do not want to get hosed by paying fees to a non-existent entity.

We are also interested in taking over the HOA, as the current HOA is not meeting their duties. Empty lots have not been mowed, common areas have not been maintained, etc.

If you are registered as a nonprofit corporation or some other entity, the registration may have lapsed instead of expired. I would have to know more. Assuming you are a private association, you should be able to establish your own governing board and manage yourselves through elected officials.
