Re: Is lawyer in the wrong

A lawyer acts negligently, that is, commits malpractice when he or she acts below the appropriate standard of care and thereby causes damages or injury to a client. From your description of the facts, it is certainly possible your lawyer has committed malpractice. It is also possible your lawyer has committed ethical violations associated with the funds, particularly if your checks have "bounced."

Attorney malpractice is complex, and you should certainly consult with an attorney with experience dealing with such issues. Act promptly. Delay could result in loss of your rights. If you believe the lawyer has violated ethical rules, you may want to contact the Oregon State Bar.
