Child decides to stay

My Grandson age 13 is living with me and my husband, his mother is a whore has many men in the house while the children are present. He asked to live with us. We are in SC and are capable of caring for him. His mother gave us a notarized letter saying we could care for his needs and schooling. How can we prevent him from returning her as she is telling him now that he can't stay with us for his next grade in school. what to do? Can he make the decision to stay. He asked.

You can either try to get the parents to sign an agreement placing the child with you and then having that agreement approved by the Court, or you can petition the Court for custody directly. The child's input is considered, but it is only one factor among many.
