Legal Question in Family Law in South Carolina

he won't leave

my husband is a habitual drunk. he doesn't help me pay any bills and i provide med. ins. for our daughter. i finally had enough and wanted him to leave. he would't leave so i did. My grandparents bought my home for me as a gift when we were separated before. I am leasing the land from a private owner and the lease is in my name only. I've tried to get a restraining order b/c of previous abuse but b/c we are married, magistrate says I can't until court. what can I do? can i make him leave? can i get an order of protection? can he take our 11 year old daughter? please help i won't have the money for a lawyer until after christmas.
