Legal Question in Family Law in Tennessee

Worried

I filed for a divorce then my spouse talked me into coming back for the childrens sakes. I have not dropped the divorce proceeding but it will be one year since I filed soon. My question is:Is my papers still legal and how long before my statute is up to go further into the courts and do I need to file an extension or something? Please let me know. Have I just lost my attorney fees that I have already paid for. Thank You

If the court has not dismissed your case, the case should still be "active." Your attorney should be able to answer that question. You may also contact the court clerk's office and ask.

Whether or not you have "lost" your attorney's fees depends on the fee agreement with your attorney. Every attorney is under a duty to explain the terms of the representation at any time. Further, it is a better practice (and sometimes ethically required) to have a written contract between the attorney and client which should explain these things. You should feel comfortable calling your counsel and ask for an update and status.

Regarding extensions, you should ask your lawyer concerning the local practices of the judges to determine if and how often cases are dismissed if no action is taken. You can also call your court clerk's office and ask the same question.
