Legal Question in Credit and Debt Law in Texas

need collection agency to correct /delete negative report to bureaus

we live in texas and have a collection agency collecting on a debt that was charged off by a credit card company in 1995. the agency is re-aging the debt and we have proof of such from 3 credit bureaus. we need them to rescind their negative reports to the bureaus as it is over the 4 year SOL for Texas and over 7 years from the charge off date. how do we make them take this off the credit bureaus? sent cease and desist letter certified mail. the texas SOL expires in 02/05. the debt was paid in full except for a small balance and the collection agency is requesting over 13,000.00 now. we have lost a home re-finance due to this popping up on the bureau. we were contacted by the new agency in late 2004- after they reported the large sum as outstanding to the credit bureaus. have proof of re-aging on recent copies of disputed credit reports. please help to see if there is something we can do to force them to take this report off our credit reports. thank you.

You need to speak with an attorney about this.

Do you have copies of all the papers? What company is this?
