Legal Question in Family Law in Texas

filing for divorce

If I plan on a divorce and currently live in TX but want to take my child to Florida and relocate, can I file for divorce from Florida or does it have to be Texas? To take my child to Florida, do I have to have a legal separation first?

Re: filing for divorce

In Texas there are no "legal separations". You have to file for the divorce where you live. In Texas are requirements are 6 months in state, 90 days in county. I don't know the Florida requirements. To have jurisdiction over the child the child must have lived in the Court's jurisdiction for a certain amount of time. Again, I don't know what the Florida requirements are. You really should talk to a family law attorney before you make any more plans.
