Legal Question in Family Law in Texas

Have physical custody of grandson for most of his four years - no legal guardianship/custody. Father is unknown and Mother abandoned him year ago and now has shown up and afraid he would be in danger if she was with him. Want to take steps so she can't just take him due to her instability, bipolar and abandonment. She does not have financial means to support him. What forms do I need to file in Orange County to protect him? Would guardianship stop her from being able to take him?

I don't know where Orange County is located.

I'm only licensed in Texas and only know Texas family law. You don't want guardianship in Texas -- you want conservatorship -- big difference.

Hire an attorney immediately to seek legal custody of this child. You cannot do this without an attorney since both parents will need to be notified of the lawsuit (custody) pending. If Dad is unknown, then it will be handled by the attorney.

Don't wait! Mom can show up anytime and without legal custody take him.

Look on this website and www.avvo.com for an attorney in your county.

If you live outside of Texas, call an attorney in your state.

Thank yo for taking in this child and providing the child with a stable home.
