Legal Question in Personal Injury in Texas

An out of state negotiator

I am an insurance adjuster, working in Dallas, TX. I have recently been contacted by an Arizona licensed attorney, wanting to negotiate a bodily injury claim that occured in Texas. The injured party is a Texas resident.

May a licensed attorney from Arizona negotiate a bodily injury settlement in Texas? Would this be considered the unlawful practice of law in Texas?

This claim, as with most, will never reach the court house.

The answer to this question may vary from state to state, but, in Texas, I believe it is lawful for an out-of-state attorney to negotiate over the phone and through the mail with a Texas adjuster. Of course, should suit become necessary, local counsel must be retained or at least associated, but, even then, the out-of-state attorney may continue to call the shots.
