Legal Question in Employment Law in Virginia

I worked for a antique mall that was shut down due to non payment of rent. I was not paid for 2 1/2 months nor paid for merchandise of mine that they sold. When speaking to the labor department they told me I would not be able to get my unpaid wages since the company is out of business. The owners were arrested for Embezzlement, and a couple of people have since gotten their merchandise money. Do I have a chance of getting my pay because a criminal act was involved?

Well, you could find out by suing these owners in small claims court for

whatever wages are owed you + court costs.
