Legal Question in Workers Comp in Texas
Workers Compensation Issue
I had been telling my managers at work over a few months last year about a problem with wrist pains but they seemed unsure on what i should do, suggesting I buy a wrist rest or find something for my pain. I work typing in a call center. As time went on they recommended I saw my doctor. The last time I reported it in March 2007, it got escalated to Human Resources and a Workers Compensation claim got filed. All this occured over a period of months, and now the Insurance company is denying my claim due to my ''ignorance'' of not reporting the workers comepnsation issue, when I was completely unaware of it being my employers responisbility to do so. Am I really the one at fault and thus, have to cover the cost of all the medical bills? Or is this my employers negligence. I have scheduled a benefit Review Conference and am still a little unsure about how this will progress. Am I really the one in the wrong here?
