Legal Question in Family Law in Alabama

Marriage

I have recently found out that my husband of five years was never divorced from his previous spouse. We were married September 17,1999. He thought that the previous spouse had taken care of the divorce (she stated that she had). Does this mean that we are not legally married? We do not have any children together. Hi is now in the process of divorcing the previous spouse, will we need to remarry?

Yes, I would recommend that you get remarried just to be on the safe side. When your husband gets his divorce decree, then you need to see what it says with regard to how long he has to wait to remarry. good luck.
