Legal Question in Employment Law in California

commission owed after termination

Hello. I'm in technology sales with

a 50/50 comp plan. My last day of

employment was 5/29/09. A deal I

have been working on for 8 months

closed on 6/19/09. Upon

termination, I asked to be paid if

this deal closes by end of June and

it was agreed by this former

employer. This agreement was

sent to me in a corporate email - it

wasn't in writing. What are my

rights to this commission payment?

Thank you.

Re: commission owed after termination

It is likely that you are entitled to the commissions. Whether there was a formal contract or an e-mail reflecting your employer's commitment to compensate you under your payment plan, it sounds like you are due commissions.

Thanks, and feel free to follow up.
