Legal Question in Employment Law in California

Does a company violate any fair employment codes if upper-management hired incompetent and inexperienced managers to run the department or a program when there were more qualified candidates to fit the job description? For an example, a candidate, who was fresh out of a university and with no experience, was given a position that require 5 years of management and 3 years of supervisory experience. This may be evident that favoritism and discrimination existed in the management's decision when selecting this particular individual. A complaint was filed to the human resources, regarding this matter, but so far. . . 2 months after the submission, no action has been noticibly taken, which may lead to believe that the issue is being ignored. Is there any legal action that can be taken to ensure that the ethics and compliance policies are being followed?

If you contend there has been civil rights violation on the basis of race, age, gender, religion, ethnic background, etc, meaning you feel you have proof you have been discriminated against on job because you are in one of those protected categories, then you can file a Claim with the Dept of Fair Employment and Housing, and follow it up with a lawsuit if appropriate.
