Legal Question in Employment Law in California

Disability discrimination please help

To whom it may concern,

My employer has know about my mental condition from the beginning. I also hurt my back at work and was given two days pay as compensation. I never signed any rights away and am still in pain from that as well. We are allowed 4 occurrences a month. I have been excused by my doctors. At times the doctor extends the time off due to pain, depression or being contagious. I am now being suspended for having 5 occurrences. I am sure that I only had four because I know how strict they are on that. I get no slack when it comes to that but for the most part slack is given to specific people. There are also other ways he takes advantage of me but I'm not sure if that's relevant. Any help would be greatly appreciated.

Re: Disability discrimination please help

First, you should see a Worker's Compensation attorney regarding your back injury and you should file a WC claim. Regarding your disability, you should present doctor's notes every time you need to take time off because of your disability. If you are a full-time employee and have worked for this employer for over one year, you may also be entitled to leave under FMLA. You should consult with an employee rights attorney for further evaluation of your case, or contact California's Department of Fair Employment and Housing.
