Legal Question in Personal Injury in California

Company party liability

My company is hosting a picnic at a nearby public park on a Saturday (non-work day). The company provides alcoholic beverages to the adult attendees. If one of the attendees drinks too much and while driving home is involved in an accident and is hurt or another party is hurt, can the company be held liable in any way. Would the answer be any different if the party was held during normal work hours on company property?

The company could be held liable. It is the same reasoning that some accident victims have used against owners of homes who host parties and then allow people to drive home under the influence. It is tuff to say whether a judge would hold the company liable, but the chance is there. If the company wants to protect themselves from any liability they should not provide any alcohol. They should encourage a safe and sober celebration. This will protect the company and the community.
