Re: file answer

You need to either have an attorney prepare the answer or you can fill in a form answer. I would advise against that since there are specific language that should be used and certain affirmative defenses that should be pled depending on what kind of case it is.

Re: file answer

Bluntly, by hiring an attorney to do so if you do not know how the legal system works. If you have been sued, you should hire someone to protect you. Call or email if you wish to discuss. 714-960-7584

Was the case filed in small claims court or superior/municipal court?

Re: file answer

You normally would have to get a form from the court where the lawsuit was filed, fill it out, pay the fee and the court clerk will give you a copy after it is filed. You then mail a copy of the answer to the plaintiff or the plaintiff's attorney. Go to the court clerk or where they sell the forms or you can possibly get the form from the internet. Good luck, From Sam M. Eagle, Attorney at Law.

Re: file answer

The simple answer is get the Judicial Council Form online and fill it out and file it. You should check the law library for potential affirmative defenses as they may be waived if not pled. Also, you should look for potential insurance coverage.
