Marriage prior to divorce being final

I have been informed that my marriage of almost four years is not legal since my husband was not divorced until last November. We both understood that the divorce was scheduled in court six months prior to our wedding date. This was in the state of Florida, and we were married in Alabama. We now live in Georgia. Am I married? I know that he did not do this with the intentions of having two wives!!

What are my options? I am not sure that I want to go down the aisle again, so how would I get my maiden name back?

One complication, we have a toddler.

If your second marraige occurred before the first was final, the second is void. You will be able to marry now to make it official. Of course, you are also free to not marry. Also, there is a potential claim of fraud if you can prove it was done intentionally.
