Legal Question in Immigration Law in Illinois

I have been in united states since 2010 and my i-94 expire last year 2011 and i was married last year aswell but my ex wife sent me out of the house and filed divorce and which i didn't show up at the court but she later got a Judgement and divorce now.. , we were separated 5 months before final divorce and no contact at all ever since then i have b'in dating someone and we looking to settle down together,hopefully get married some-time next year..

Here my Question: Would it be to soon to get married and then file for change of status? She's gonna be a citizen by January.

Please kindly advice on what to do.

As long as you are legally divorced, you can marry a U.S. citizen, who can then immediately file for your permanent residency. Marriage-fraud issues might come up, so I suggest you speak with an Immigration Attorney about representation.
