Legal Question in Family Law in Indiana

house in foreclosure

My fiance is waiting for his divorce to be final. The hold up is that his wife had wanted to keep the house and then decided she couldn't afford it and it is going into foreclosure. Do we have to wait until the foreclosure is complete before the divorce will be final or can it be finalized prior? We are trying to plan our wedding and the foreclosure will probably not be complete for at least a year.

Re: house in foreclosure

The divorce decree should deal with the debt. It is unclear whether the divorce is final. He probably needs to talk to a lawyer. Some details could make a difference.

It is cleaner if you wait, but contingencioes can be built into an agreement concerning the foreclosure.

See an attorney.
