Legal Question in Personal Injury in Maine

My mother got bitten by a dog at a home where she was doing some house cleaning. The owner was holding the dog and told my mother it was harmless and okay to walk by, but when she did, the woman let go, and it attacked her. She offered no help, and has been very rude and unwilling to help with the medical bills. My mother's fear of dogs is back, and she lost her two clients in the meantime. The woman is a lawyer, the dog was not properly restrained, and she would not offer proof of rabies vaccination. What can we do?

I am sorry to hear about your mother's incident. I hope she is doing better. There are 2 different ways to pursue this, one of which would include a lawsuit for pain and suffering, as well as any other damages such as medical expenses. The other way to pursue this is by filing a claim with the home owner's insurance company. Medical expenses will be covered dollar for dollar in the latter case, regardless of whether the homeowner was negligent or responsible in any way. A lawsuit may or may not be advisable depending upon whether there was any indication that the dog had dangerous tendencies, or that it had any history of biting people.filing suit requires that we be able to prove negligence. If the homeowner will not provide her insurance company information, then it may be necessary to retain an attorney to pursue this. I would be happy to discuss this with your mother further.
