On choosing the best Trademark attorney! Help!

I contacted a Law firm in MA on 6/30/09 and the paralegal talked to me instead. Then he said they can trademark the name I want for $800.00 it seemed fine. I asked him if he needed anything else from me like a business plan, he said nope! then he asked me what age group do I belong to and if I'm in facebook?

I find his need to proposition me disgusting and I would like to know

If that is normal for the law firm to just do a trademark without talking to the client and asking what exactly is the trademark used for?

that sounded very weird to me!

Hi there. Perhaps you just had an initial phone consult with the paralegal, who would then give your contact information to an attorney. The attorney certainly does need some specific details from you regarding use of the trademark in order to file the application (but not your whole business plan or your facebook. lol.)

If you were offended by the paralegal's questions, there must be more facts than what you stated (even if it's just a feeling that this guy was being disgusting). In any event, there are SO many trademark attorneys out there, and you should only work with one with whom you are totally comfortable and trust - including his/her support staff.

You should know that it is not necessary for you to find an attorney in your area to file your trademark application, although it may make you more comfortable to be nearby so you can have 'face time' with the attorney. An attorney licensed in any of the 50 states can file your trademark application in the USPTO.

Keep looking, and I'm sure you will find the right attorney for you.

It is necessary to know what the trademark is used for - a description of the goods and services is on the application. It is also necessary to know if the mark is currently in use in commerce (and since when), or whether it is an intent to use application. But beyond that, things like a business plan are not all that relevant. And certainly your age (assuming you are over the age of majority) and whether you are on facebook are not relevant, although I suppose it would be necessary to make sure you are of legal age (I see no reason to ask about facebook).
