Child Support

my father was just served today saying he was in contempt for not paying child support. I am now 23 years old. He has a notorized letter from my mother stating the child support was paid in full as well as all arrears were paid in full. I was in my mothers custody from the age of 6 until i was put into foster care at age 15. my father got custody of me when i was 17. He sent a letter to our district attorney as well as a copy of the letter my mother sent saying everything was paid in full. Hes due to go to court in a few months. what does he have to do to finally have all this put to rest

Thank you for your inquiry.

If your father's child support was not being garnished from his paychecks and they had a private agreement to pay your mother directly the notarized statement should be enough to have the arrearages forgiven.

I disagree with Mr. Herbe. The DA doesn't accept the notarized letter. I had a mom appear in Court, the DA looked at her ID to confirm she was the Mom and they disputed it.

We are going to the Family court Judge to modify the Order to have the record show paid in full.

If I were your father, he should go to Court and tell the judge the story. If they are satisfied, then fine, otherwise, he will probably have to hire an attorney to go to Family Court to fix. He would have to go to the County where the last support order was entered.
