I live in a mobile home park in the state of NH. My landlord raised the rent and only gave us 37 day noticed. They notified us on 8-24-07 that it will go up on 10-1-07 Now I did not pay the lot increase because under RSA 205-A:6 they did not give us 60 day noticed. I have just received a eviction noticed on 12-7-07 under RSA 205-A:4 My question is can I sue the park owner and the law firm for a illegal action for not following the law. No I did not tell the landlord the law and why I did not pay the lot increase.

Although the notice period was short, the landlord may issue a new notice to increase the rent. You'd have to pay from that point forward. You may be able to defeat the current eviction, but are likely to lose the war in the long run. You have to read RSA 205-A along with the eviction statues. You should consult directly with an attorney to review all the facts and circumstances so you can plan an appropriate strategy if you decide to go foward with use of the judicial system.
