Legal Question in Credit and Debt Law in New Jersey

statute of limitations

I recieved a notice from collection company requarding a debt they claim I owe to GPU Energy. This is the first I heard of it. They claim it is from 5/3/95. I no longer have those records. I only keep records for 3 years. but I don't believe I owe it since I have always paid my electric and never had it shut off. How can they get away with this? Can they really wait 6 years to collect without sending me proof?

Re: statute of limitations

A creditor is barred by the statute of limitations from collecting on a debt over six years old. Tell the debt collector that you will not pay it because they are legally barred from obtaining a judgment against you. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention LawGuru, there will be no charge for your first consultation. Good luck! Rob Gleaner
