Mobile home and Property
My parents have made a handshake deal with a person who agreed to let them buy her trailer and just make payments on it. They moved it on their property, paid for all the costs of moving and upgrading up to city code, have been making payments for her on the trailer and all of a sudden she wants to sell the trailer to someone else. Does she now have the right to take that trailer off of their property even though they have been making payments on it? Also, can they get the money back from her that they put into it, which is about $8,000.00 including payments on the trailer before she moves it off of their land? Please help, they will be out of a home if they don't find out the correct answer and their rights. Thank you

These are not the kind of questions that can be answered in this format. Your parents should get legal counsel asap! It will be best for all if they can get an agreement in writing with the owner of the trailer to resolve the issues, however, you must be careful how you do this and that you have an enforceable agreement.

It would be best to have gotten a written agreement at the time of purchase, but it sounds like its too late for that. However, your parents may be able to present sufficient evidence that they have a valid contract to purchase the mobile home. If your parents have honored the verbal agreement, you should contact an attorney immediately. Your parents need to put the seller on notice that they will demand that the seller honor their agreement, and they should do this before the situation is complicated by the seller selling the home to another party.
