Legal Question in Employment Law in California

In '08, 3 days prior to the end of my 90-day probation at AMTRAK, I reported a Conductor for stealing. Has too much time past?

Albeit, in my role as an LSA (Lead Service Attendant) I was charged with ensuring the companys policies regarding theft while on-board were upheld, I quickly learned doing the right thing at AMTRAK is a career-killing move. Prior to my report, after working with numerous train crews, my appraisals and working relationships were excellent. Although the Conductor did admit to the thefts, the company refused to afford me any protection from the powerful conductors union who immediately approached me and threatened to derail my career with AMTRAK. Upon my refusal to retract the report they instructed the members of the other unions to use whatever tactics necessary to prompt my resignation. These tactics included direct threats to my person, property and my character. I resigned in fear.

You don't get to wait five years and then think about taking legal action. You had a union grievance to bring, years ago. You MAY have had a civil claim to bring, years ago. You filed neither. Those legal trains have long since left the station.
